Terms of Service

Topsite World (the "Provider") is providing a service to individuals (the "User").

To use our service, you must agree to all the following:

1. Services Provided

Under this agreement, the Provider will provide the following services; which herein known as the "Services" in this agreement:

Access to the administration functions of your topsite account.
Access to utilize the Providers servers to host your topsite list.

The Provider reserves the right to, at any time, for any reason, terminate the Services to the User without any warning.

2. Content Restrictions

This is a free service provided that you agree that your web site conforms to the following content standards:

User's topsite list may not contain pornography, warez, mp3, hacking, racism, hate crimes, or any other material deemed illegal acticity under United States law.
User's list may not link to any of the above stated material.

If your Web site does not conform to these standards, you are not eligible for this service.

3. Use Restrictions

This is a free service provided that you agree that your web site conforms to the following use standards:

User's may not send unsolicited email (spam) in order to promote their list.
User's may not abuse or misuse our servers or Services in ways in which they were not intended to be used.

4. Disputes

In the event of a dispute about or involving the Provider and/or the Services, by using the Services, you agree that the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California.

5. This Service Is Provided "As Is"

THE PROVIDER SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. THE PROVIDER GIVES NO WARRANTY, EXPRESSED OR IMPLIED, FOR THE SERVICES PROVIDED, INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THIS NO WARRANTY EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY THE PROVIDER OR ITS PROVIDERS BEYOND THE FEES PAID BY CLIENT TO PROVIDER FOR SERVICES. WE MAKE EVERY EFFORT TO BACKUP OUR DATA, BUT WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA.

6. Modification of This Aggreement

This agreement may be modified at any time at the sole discretion of the Provider. If this agreement is modified, the user has five days to terminate their account with the Provider or it will constitute acceptance of the modifications.
